Foi sancionada, pela presidente Dilma Rousseff, no último dia 23 de Abril, e entrará em vigor no final do mês de junho, a Lei nº 12.965/2014, oriunda do PL 21.626/11, também conhecida como “Marco Civil da Internet”.

Os debates estavam sendo travados no Brasil desde 2009. Por muitos chamada de “a Constituição da Internet”, a norma em questão veio para estabelecer princípios, garantias, deveres e direitos para a utilização da rede mundial de computadores no Brasil, tornando-se um novo marco regulatório para o setor de informática.

Abrindo o texto da lei, disposições preliminares (art. 1º a 4º) trazem os fundamentos, princípios e objetivos da disciplina do uso da Internet no Brasil, ficando evidenciado que a liberdade de expressão deverá conviver com a proteção da privacidade na rede. A tensão entre esses dois princípios – que merecem ser ponderados e harmonizados, mas não hierarquizados – segue em diversas outras disposições da Lei, como veremos a seguir.

1 What are the principal statutes regulating advertising generally?

The legal basis for the provision of advertisement regulation is set forth by the 1988 Brazilian Constitution, which determines that the law will provide for special rules on the advertising of products and services that may offer health and environmental risks, such as tobacco, alcohol and medicines (section 220, paragraph 3, II, and paragraph 4).
