Newsletter 2016.05 We are prepared for the new Code of Civil Procedure!

Kasznar Leonardos Advogados' litigation team, specialized
in Intellectual Property matters, discussed the concrete
implementation of the new Code of Civil Procedure
(effective as of March 18, 2016) in a workshop held in the
São Paulo offices, on March 4 and 5, marking the closing
of a profound cycle of studies on the subject.
 
Nearly a year ago, the new Code of Civil Procedure (NCCP) was enacted. The long-waited law incorporates a bold project of changing the culture of the relation between the parties in a lawsuit. The NCCP proposes a replacement of Brazilian traditionally adversarial culture in litigation by
a more collaborative approach, in which the parties loyally cooperate towards the resolutions of their conflicts. Changes that big are neither easy nor simple: some procedures remained intact; in some others, the NCCP confirms propositions previously upheld by case law; finally, some procedures underwent deep changes.
 
To understand thoroughly the reforms, members of the Team have read and re-read books and articles on the matter, attended several courses, presentations and seminars during the last years, discussed the numerous questions raised and made hundreds of notes for reference. The attorneys' individual preparation regarding the NCCP was the cornerstone of the firm's activities and investments in training for 2015.
 
Discussions matured and, on December 2015, the Team started collectively debating the concepts in and the operations under the NCCP. During January and February 2016, very frequent meetings allowed the Team to deepen the awareness about the impacts of the dispositions contained in the NCCP on the firm's monitoring routines
and internal proceedings and, most of all, on the drawing up of new strategies for defending clients' interests.
 
With a Team split in three cities – Rio de Janeiro, São Paulo and Rio Grande do Sul, all sixteen attorneys, including six partners, made the conclusions, the testing of the thesis and the final arrangements in a geographically coordinated manner.
 
From March 18, 2016 on, each of our clients will be in position to experiment the results of such work, in the reliance of the positions, in the confidence of the strategies and in the maintenance of the quality of the services rendered by Kasznar Leonardos Advogados.

IP Licensing In Brazil: Brazilian Antitrust Watchdog Reviews Its Rules On Agreements Subject To Prior Approval

 It will come into force next Thursday (November 24, 2016) a new resolution issued by CADE (Conselho Administrativo de Defesa Econômica), the Brazilian antitrust authority, that redefines the rules for the submission of “associative contracts” for prior approval.

The changes to Brazil’s Civil Procedure Code are welcome although it may take some years for them to be put into practice

After many years of scholarly and political debate within the National Congress, the new Brazilian Civil Procedure Code was passed into law last year and came in force in March 2016, replacing its 1973 predecessor. It is expected that the new rules of civil procedure will reduce litigation in Brazil by favouring alternative dispute resolution methods as well as by allowing and incentivising cooperation between the parties of lawsuits. In particular, we shall address some possible impacts for intellectual property litigation
