Interview: João Vianna for Managing IP

Our partner João Vianna was interviewed by Managing IP, a website specializing in Intellectual Property analysis. The article featuring Vianna discusses the progress and challenges faced by lawyers and firms in Brazil related to patent backlog.

For a long time, Brazil was known for its slow patent registration processes, but this scenario seems to be changing. Among 6 years, the average duration of actions has reduced from 90 to 25 months. Additionally, the INPI (National Institute of Industrial Property) has increased its workforce to enhance the process.

According to Vianna, patenting process can be optimized through the Patent Prosecution Highway (PPH), which has a high request approval rate and delivers decisions more quickly. However, he highlights that INPI has a limited number of patent grant requests per year. Furthermore, applicants can only access the system once a week.

He also emphasizes that the process improvement has increased the workload for Intellectual Property firms. When it comes to Kasznar Leonardos, he mentions that the firm sought to mitigate the high demand by balancing its team of attorneys with new hires to ensure that the growing number of new consultancy work and patent registration requests in Brazil were met.
